- Don’t scrape it, hack it, or use it to misrepresent yourself or others.
- The content here is for general information — it’s not personal advice and shouldn’t be your sole basis for big decisions.
- Browsing this site doesn’t enrol you on a course. Apprenticeship enrolment uses separate paperwork and follows ESFA funding rules.
- If you’re a consumer (using the site for personal not commercial purposes), nothing in these Terms takes away your statutory rights under UK consumer law.

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the TESS Group website at tessgroup.co.uk and any subdomains we operate (the “Site”). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Note on training and apprenticeships: These Terms cover your use of the Site only. Where you enrol on a TESS Group apprenticeship, short course or other training programme, the contractual relationship between you, your employer (where applicable) and TESS Group is governed by separate enrolment paperwork, learner agreements and (for apprenticeships) the funding rules issued by the Education and Skills Funding Agency. Those documents take precedence over these Terms in respect of training delivery.

3. Acceptance of Terms
By using the Site you confirm that:
- You have read, understood and agree to be bound by these Terms.
- You agree to comply with our Privacy Statement and Cookie Policy, which form part of these Terms.
- If you are accepting these Terms on behalf of an organisation, you confirm you have authority to do so.
We may update these Terms from time to time (see Section 15). Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
4. Permitted Use of the Site
You may use the Site for lawful purposes, including:
- Researching our apprenticeships, short courses and learning programmes
- Submitting enquiries through our contact forms or newsletter sign-ups
- Downloading content we have made available for personal or internal business reference
- Sharing links to our pages on social media or in your own communications
5. Prohibited Use
You agree NOT to:
- Use the Site in any way that breaches applicable UK or international law
- Attempt to gain unauthorised access to any part of the Site, our servers, or any connected database
- Introduce viruses, malware, trojans, worms, logic bombs or other harmful material
- Conduct any automated scraping, harvesting, or data mining of the Site without our prior written consent
- Reproduce, duplicate, copy or resell any part of the Site for commercial purposes other than for which it is intended
- Impersonate TESS Group, any of our staff, or any other person
- Use the Site to send unsolicited or unauthorised advertising or promotional material
- Submit false, misleading or fraudulent information through any form on the Site
- Interfere with or disrupt the Site or any servers or networks connected to the Site
6. Intellectual Property
All content on the Site — including text, graphics, logos, images, video, software, course materials, downloadable resources, the “TESS Group” name and our service marks (such as Coachy) — is owned by TESS Group or our licensors and is protected by UK and international copyright, trademark and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to:
- View and access the Site for personal or internal business reference
- Print or download individual pages for that purpose
- Quote short extracts in good-faith editorial, research or commentary contexts, with appropriate attribution to TESS Group and a link back to the source page
You may NOT, without our prior written permission:
- Republish, sell, rent, sub-licence, or commercially exploit any content from the Site
- Use any of our trademarks, logos or branding in your own materials
- Modify, adapt, translate or create derivative works from any content on the Site
- Remove or alter any copyright, trademark or other proprietary notices
7. Educational Content & Coachy AI Tutor
Important: Site content is informational, not advice
Articles, blog posts, calculators, fit-assessments, AI-related explainers and similar content on the Site are published for general information only. They are not a substitute for tailored professional, legal, financial, regulatory or career advice.
While we take reasonable care to keep information accurate and up to date — in particular regarding apprenticeship standards, funding rules and qualifications — the apprenticeship and skills landscape in the UK changes frequently. You should check current rules with us, with the Education and Skills Funding Agency, or with the relevant awarding body before making decisions based on content you read here.
About Coachy
Coachy is the AI tutor included with the AI & Automation Practitioner Level 4 apprenticeship and accessible at coachy.tessgroup.co.uk. Coachy is a separate service with its own terms presented on first launch and is also covered by the wider TESS learner agreement.
Coachy generates responses using large language models. While we work to ensure quality, AI-generated content may occasionally contain errors, omissions, or out-of-date information. You should not rely on Coachy as the sole source of advice for assessments, professional decisions, or compliance-sensitive matters.
8. User-Submitted Information
When you submit information through forms on the Site (for example, the contact form, newsletter sign-up, fit-assessment quizzes, or download requests), you confirm that:
- The information you provide is accurate and submitted by you (or by someone authorised on your behalf)
- You consent to TESS Group processing that information in line with our Privacy Statement
- You are not using a false identity, a disposable address, or another person’s contact details without authorisation
We may decline, delete or report submissions that appear to breach these Terms or applicable law.
9. Apprenticeship Enrolment is a Separate Contract
Nothing on the Site — including programme pages, fit-assessment recommendations, blog content, downloadable guides, or interactions with the Coachy AI tutor — constitutes an offer to enrol you on, or a contract for, an apprenticeship or training programme.
Enrolment requires:
- A formal application and eligibility check
- Employer commitment (for apprenticeships) including a signed apprenticeship agreement and commitment statement
- A signed learner agreement with TESS Group
- Compliance with the relevant funding rules and apprenticeship standard
Programme details, durations, qualifications and outcomes shown on the Site are indicative and may change. Final terms are set out in the enrolment paperwork issued at the point of joining.
10. Third-Party Links and Services
The Site contains links to third-party websites and services that we do not control, including Trustpilot, social media platforms, awarding-body sites, Microsoft, Google, and others. We provide these links for convenience only.
We are not responsible for the content, accuracy, privacy practices or availability of any third-party site or service. Your use of any third-party site is governed by that site’s own terms and privacy notice. The presence of a link does not imply endorsement.
11. Limitation of Liability
Site provided “as is”
The Site is provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, free of viruses, or that any information will be complete, accurate or current.
To the fullest extent permitted by law, TESS Group, its directors, employees and contractors will not be liable for:
- Loss of profits, revenue, business, anticipated savings, goodwill, or opportunity
- Loss or corruption of data
- Indirect, special, consequential or punitive losses
- Any loss arising from your reliance on Site content rather than tailored professional advice
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be limited or excluded under English law
12. Indemnity (Commercial Users Only)
If you are using the Site in the course of business or on behalf of an organisation (a “Commercial User”), you agree to indemnify and hold harmless TESS Group, its directors, employees and contractors against any claims, losses, damages or costs (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Site, or your infringement of any third-party right.
This indemnity does not apply to consumers using the Site for personal, non-commercial purposes.
13. Consumer Rights
If you are a consumer (an individual using the Site for personal purposes outside any business activity), nothing in these Terms affects your statutory rights under UK consumer protection law, including the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008.
In particular, nothing in these Terms limits or excludes any right or remedy that cannot be limited or excluded by law as against a consumer.
14. Privacy and Cookies
Our handling of personal data is set out in our Privacy Statement. Our use of cookies and similar technologies is set out in our Cookie Policy. Both form part of these Terms.
15. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our services, the law, regulatory requirements, or industry practice. The “Last Updated” date at the top of this page indicates when the Terms were most recently revised.
Continued use of the Site after a revision is posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
16. Termination
We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms or used the Site in a way that may harm TESS Group, our learners, or other users.
17. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales.
You agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
